GDPR and the processing of personal data
THE INFORMATION OBLIGATION OF THE CONTROLLER ON THE PROCESSING OF PERSONAL DATA OF ANY NATURAL PERSONS WHOSE DATA HE PROCESSES IN THE PERFORMANCE OF HIS LAWFUL TASKS
in accordance with Articles no. 13 and 14 of Regulation (EU) No. 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, repealing Directive No. 95/46/EC (General Data Protection Regulation) (hereinafter referred to as “the Regulation”).
Aldea Club s. r. o. treats the personal data collected from you, our clients and contractors responsibly and we would like to inform you of the following facts about the protection of personal data.

3. We use the data we have collected about you for the following purposes:
a) Communication with you
We use your contact details to send you communications related to the provision of our services or to respond to you when you ask us a question.
b) Security and protection of rights
We also use your data to ensure the security of the services we provide, to respond to claims made against us, in proceedings before governmental and other authorities that control our activities, and to enforce claims made against us.
c) Purchase details
We require you to purchase the data necessary for its processing, or withdrawal from the purchase contract. The processing is not necessary for the performance of a contract of sale to which the data subject is a party or to carry out pre-contractual measures at the request of the data subject. We therefore process your data as necessary to fulfil your requests. You do not enter any information in our online shop that directly relates to the handling of the money in your accounts. All currently offered forms of electronic banking (payment for goods and services via the Internet) are made directly on the bank’s website, which only provides us with information about the success or failure of the payment and your name or account number (so that we can identify the payment and return it if necessary).
d) Sales and commercial activity
We carry out processing for the purpose of concluding a contract and its performance, in particular for the receipt and registration of an order, order processing, dispatch of goods, issuing a receipt and dealing with withdrawal from the purchase contract.
e) Marketing and advertising
If you give us your consent, we also keep your e-mail address for the purpose of sending you information about special offers and our news. We send our clients thank you emails for their trust and other irregular and occasional emails. You can easily cancel the sending of these emails by informing us by email to: info@aldeaagency.com or by any other appropriate means. If you contact us or participate in a survey or consumer competition, we will retain data such as your name, contact details or the message or information you have delivered or communicated to us. We process your personal data for the purpose of presenting and promoting ourselves or presenting and promoting events and promotions held by Aldea Club, Ltd.
f) Data collected when using our services
When you use our services, we also collect data about how you use them. This is information relating to your interactions with our services, such as when you access our site and what you search for on it. We also collect information from cookies and similar tools.
(g) Invoicing and accounting
We process your personal data mainly on the basis of the Accountancy Act.
h) Jobseekers
If you are interested in employment with us and contact us directly, we collect and store your data in our database of suitable candidates only with your consent. Candidates included in the database are then contacted for the purpose of participating in the selection procedure.
With your consent, in this case we also store your e-mail address or any other data that you make available to us for this purpose, such as your name, the position in which you are interested or your preferred position.
4. Data we collect
We process your personal data to the following extent:
a) In connection with communication with you pursuant to 3a): title, name and surname, e-mail, telephone number, address, cookies, other data provided by consent and for a period of 5 years. since the last communication;
b) In connection with the security and protection of the rights under 3b): title, name and surname, e-mail, telephone number, address, bank account number, cookies, sound recording, image recording and for the period of time prescribed by law;
c) In connection with the purchase, resp. by the execution/withdrawal of the purchase contract according to point 3c): title, name and surname, e-mail, telephone number, address, cookies and for a period of 5 years. / for the duration of the consent;
d) In connection with sales and business activities according to point 3d): title, name and surname, e-mail, telephone number, address, cookies for a period of 5 years. / for the duration of the consent;
e) In connection with marketing and advertising according to point 3e): title, name and surname, e-mail, telephone number, address, bank account number, cookies, sound recording, image recording, other data provided by consent and for a period of 5 years. / for the duration of the consent;
f) In connection with the data obtained when using our services according to 3f): title, name and surname, e-mail, telephone number, address, cookies for a period of 5 years. / for the duration of the consent;
g) In connection with invoicing and accounting according to point 3g): title, name and surname, e-mail, telephone number, address, cookies for a period of 5 years. / for the duration of the consent;
h) In connection with the expressed interest in employment under point 3h): title, name and surname, e-mail, telephone number, address, image record, other data provided by consent for the duration of the selection procedure.
5. Legal bases
The legal basis for processing your personal data is:
- Consent – the data subject has consented to the processing of his or her personal data.
- Performance of a contract – the processing of personal data is necessary for the performance of a contract to which the data subject is a party or to carry out pre-contractual measures at the request of the data subject.
- Compliance with our legal obligations – the processing of personal data is necessary for compliance with the legal obligation of the controller.
- Legitimate interest of the Controller – the processing of personal data is necessary for the purposes of the legitimate interests pursued by the Controller or a third party, except where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require the protection of personal data, in particular where the data subject is a child.
6. Transfer of personal data to third countries
We do not actively transfer your personal data to third countries outside the EU.
7. Privacy Policy
In accordance with the requirements of applicable legislation, we take all necessary security, technical and organisational measures to protect your personal data. The electronic data is stored in a protected database on a server that is ours or is reserved for us. We protect the database containing personal data from damage, destruction, loss and misuse.
8. Retention period of personal data
We process personal data that we process on the basis of the consent you have given us for the period of time specified in the consent, respectively. until the consent is withdrawn.
We process personal data that we process on a legal or contractual basis for the duration of the contract or for the period of time provided by law or other generally binding legal regulation.
We would like to inform you that even if one of the reasons for processing is no longer applicable, this may not mean that we will stop storing your personal data. This is because we can and sometimes must process this personal data for another purpose with a different legal basis.
9. Rights of data subjects
The fact that we process your personal data gives you certain rights. If you exercise any of the rights set out below, we will inform you of the processing of your request within 30 days from the date of receipt. In justified cases, we may extend this period to 60 days, which we will inform you about.
You can exercise your rights by sending an email message or a written request to our contact details.
Please include your first name, last name, email address, or permanent address in your application. If you do not provide us with the above information, it will not be possible to comply with your request. We require this information from you in order to verify your identity and not to provide your personal data to an unauthorised person.
Right of access to data
You have the right to obtain confirmation from us as to whether personal data is being processed about you and, if we are processing your personal data, we will provide you with information about what data we are processing about you, for what purpose, to whom your personal data has been disclosed, whether it has been transferred to a third country and how long we will keep your personal data.
Right to repair
If you believe that our company is processing incorrect personal data about you, you can exercise this right and ask us to correct it. We care about processing the right personal data about you, so be sure to exercise this right whenever, for example, you move or any of your personal data that is important to your relationship with us changes.
Right to erasure (right to be forgotten)
You have the right to erasure of your personal data that we process about you if the following conditions are met and no legal exceptions apply:
- the data are no longer necessary for the purposes for which they were collected
- you withdraw your consent to the processing of your personal data and there is no other legal basis for processing it
- you object on the basis of your particular situation to the processing of your personal data processed on the basis of legitimate interest and the legitimate grounds for processing do not prevail or you object to processing for the purpose of direct marketing
- personal data have been unlawfully processed
Should your personal data be disclosed and you exercise your right to erasure with us, we will also erase such disclosed personal data. We will also inform other recipients of your personal data that you have exercised your right to erasure and should therefore erase all references to your personal data, if technically feasible in view of the technology available and the cost of carrying out these measures.
Right to restriction of processing
You also have the right to ask us to temporarily restrict processing in the following cases:
- if you believe that we are processing incorrect personal data about you, until such time as the accuracy of that personal data is verified
- the processing of your personal data is unlawful and you choose to request a restriction on the processing of your personal data instead of its erasure
- we no longer need the personal data for processing purposes, but it is necessary for your own purposes of establishing, exercising or defending your legal claims
- if you object to the processing of your personal data, pending verification that the legitimate grounds for processing your personal data outweigh your legitimate interests
Right to data portability
You have the right to obtain the personal data that we process about you on the basis of consent and/or contract and that we process by automated means, in a structured, commonly used and machine-readable format. You can also transfer this data to another person, so if technically possible, we will transfer your personal data directly to the controller of your choice at your request.
Right to object
You have the right to object, on grounds relating to your particular situation, to the processing of your personal data which is carried out on the basis of our legitimate interest, including the right to object to profiling based on our legitimate interest.
You also always have the right to object to the processing of your personal data if it is processed for direct marketing purposes.
10. Filing complaints
If you believe that the processing of your personal data by our company is in violation of applicable data protection laws, you have the right to file a complaint with the Office for Personal Data Protection of the Slovak Republic.
